General Terms and Conditions of Sale

Article 1: RESERVATIONS AND PAYMENTS

Reservations are made by phone, email, or online at www.domainederochebonne.com or www.seasidefrance.com. Each reservation must be accompanied by a payment that includes:

  • A deposit of 35% of the total price of your rental and additional services.
  • THE EXCEPTIONAL AMOUNT FOR YOUR STAY must be paid no later than 45 days before your arrival date. No deductions are allowed in case of late arrival or early departure.
  • Electricity / Heating: Electricity and heating are not included for stays between October 1 and May 1. However, they are included for the rest of the year. Each house is equipped with electric heaters and a standalone gas heater, which efficiently heats the house and is very economical. We can provide gas bottles upon request.

In accordance with Article L.121-21-8 of the Consumer Code, we remind you that lodging services, which must be provided on a specific date or for a fixed duration, are not subject to the 14-day withdrawal right.

Article 2: RATES

The prices and information published on our website www.domainederochebonne.com are base prices that do not include optional services (texts and photos for illustrative purposes). Prices established at the time of booking include applicable VAT rates.

Prices are subject to change during the season.

Article 3: PURPOSE

These general terms and conditions apply to all tenants who have booked a stay at Domaine de Rochebonne and are exclusively for the use of seasonal rentals by SARL Domaine de Rochebonne. The term "tenant" refers to the tenant(s) who have previously booked or arrived at the property and have made a holiday accommodation booking with SARL Domaine de Rochebonne. Any booking made through SARL Domaine de Rochebonne constitutes a contract. SARL Domaine de Rochebonne owns and administers the websites www.domainederochebonne.com and www.seasidefrance.com. Only French law is applicable to the contract.

Article 4: GENERAL PROVISIONS

SARL Domaine de Rochebonne undertakes not to disclose any information of any kind, on any medium, that the tenant might have communicated during the execution of this contract.

However, these provisions do not apply to information requests made by administrations and/or courts.

Article 5: PAYMENT AND CONTRACT

A deposit will be paid at the time of booking the holiday home in an amount representing at least 35% of the rental price. A deposit is considered a deduction from the rental price. An additional 30% is payable at least 90 days before arrival, and the remaining balance is due at least 45 days before arrival. In case of cancellation, up to 90 days before your arrival, 50% of the deposit is refundable. In case of cancellation 89 days or less before your arrival, no deposit is refundable. Charges not included in the rent are payable at the beginning of the stay.

Article 6: OPTIONAL SERVICES

End-of-stay cleaning: If you do not subscribe to this option, you must return the accommodation clean and tidy in the state you found it, and cleaning materials and products are provided. A cleaning checklist will be given to you upon arrival.

One-bedroom house: €25

Two-bedroom house: €35

Three-bedroom house: €45

Four-bedroom house: €55

Five-bedroom house: €65

Chateau: Included unless otherwise stated.

Towels and bed linen: All our rental rates include bedding, bath towels, and pool towels. Our linen is prepared by a professional laundry service. Beds are made upon your arrival from May 1 to October 1; outside this period, this service is not included.

High chair: €10.00

Cot: €10.00

Dog or cat: €10.00

Article 7: ACCOMMODATION CAPACITY

The accommodation is intended for a specific number of occupants. Under no circumstances may it be occupied by more people (children and babies included). If this is the case, the management reserves the right to refuse entry to any additional person.

Minors unaccompanied by their parents or legal guardians will not be admitted.

Under no circumstances can the tenant claim any right to remain on the premises after the end of the initially agreed rental period, except with the agreement of SARL Domaine de Rochebonne.

Article 8: USE OF THE PREMISES

SARL Domaine de Rochebonne will provide the accommodation in accordance with the description it has made and will maintain it in good working order. The tenant will enjoy the rental peacefully and will make good use of it according to the purpose of the premises. The rented premises are for temporary accommodation or holiday purposes, excluding any professional activity of any kind (maximum 3 months).

Upon departure, the tenant agrees to return the rental as clean as they found it on arrival unless they have paid for the cleaning option. All significant repairs made necessary by the negligence of the tenant during the rental will be at their expense.

The rental cannot in any case benefit third parties, except with prior agreement from SARL Domaine de Rochebonne. The tenant is prohibited from subletting, even free of charge, under penalty of contract termination; the total amount of the rent remains acquired or due to SARL Domaine de Rochebonne.

The installation of tents or parking of caravans on the property rented is prohibited, except with prior agreement from SARL Domaine de Rochebonne.

The number of tenants may not exceed the maximum capacity indicated in the catalog or description. Exceptionally and subject to the agreement of SARL Domaine de Rochebonne, this rule may be waived. In this case, SARL Domaine de Rochebonne will be entitled to collect a price increase that must be communicated in advance to the tenant and included in the rental contract.

Article 9: POOLS. SAFETY AND REGULATIONS

Use of the pools: The domain's pools are accessible to residents according to published hours and are not supervised. The safety of children and adults using the pools is the sole responsibility of the tenants.

Specific rules: Bringing glass into the pool area is prohibited. Only containers made of plastic, metal, or other unbreakable materials are allowed. All waste must be properly disposed of outside the water.

Liability: SARL Domaine de Rochebonne disclaims all liability for accidents or injuries occurring in or around the pool. Tenants using the pool agree to do so at their own risk.

Article 10: NOISE

This is a family-friendly place and is not suitable for any type of party. No noise after 11 pm. If you decide to play music, you must consider other guests and keep the volume to a minimum. No music after 11 pm.

We will not tolerate any aggressive behavior. Any person who is aggressive, angry, or disrespectful towards other guests, staff, or management will be required to leave immediately without any refund.

SARL Domaine de Rochebonne reserves the right to terminate a tenant's stay without justification.

Article 11: PETS

SARL Domaine de Rochebonne accepts pets, the tenant must specify which pets will accompany them. Please contact us before bringing your pet.

Pets are not allowed inside the pool enclosure.

Article 12: INVENTORY

An inventory of furniture and other equipment is conducted at the beginning and end of the stay by SARL Domaine de Rochebonne or its duly authorized representative, and the tenant. If it is not possible to conduct the inventory upon arrival, the tenant has 24 hours to verify the displayed condition of the premises and report any discrepancies noted to Domaine de Rochebonne. After this period, the rented goods are deemed free of damage upon the tenant's arrival. A contradictory inventory of exit must be established. The tenant agrees that this inventory may be conducted either by SARL Domaine de Rochebonne or its representative. If Domaine de Rochebonne or its representative notices any damage, they must inform the tenant within a week.

Article 13: CANCELLATION POLICY

In the event of cancellation of your stay by a decision of the French government making the stay impossible due to one or more restrictions imposed by the French government, SARL Domaine de Rochebonne will issue a credit for the value of the reserved stay valid for 18 months OR will proceed with a full refund depending on the measures, decisions, and regulations in force. This cancellation policy is effective only in the case where the reserved stay would become impossible following government decisions. Otherwise, our standard cancellation policy applies.

Article 14: CANCELLATION / TERMINATION OF STAY

We remind you that in application of the measures provided for in articles L221-28 and following of the Consumer Code, none of the services offered by SARL Domaine de Rochebonne is subject to a right of withdrawal. Therefore, any cancellation made by the client after booking and before departure will have the following consequences:

14 a) CANCELLATION AT THE INITIATIVE OF THE TENANT

In case of cancellation, up to 90 days before your arrival 50% of the deposit is refundable. In case of cancellation 89 days or less before your arrival, no deposit is refundable. Charges not included in the rent are payable at the beginning of the stay.

If the tenant does not show up within 24 hours of the arrival date indicated on the contract, this contract is terminated and SARL Domaine de Rochebonne can dispose of its rental. The deposit is also acquired by SARL Domaine de Rochebonne, which can demand the payment of the balance of the lease.

14 b) TERMINATION AT THE INITIATIVE OF SARL DOMAINE DE ROCHEBONNE

In case of termination by SARL Domaine de Rochebonne, THE COMPANY will refund the tenant the full amount paid. The tenant may not claim damages or compensation for moral and financial harm suffered.

14 c) IN CASE OF TERMINATION DURING THE CONTRACT

When the termination of the contract by SARL Domaine de Rochebonne occurs during the lease term, it must be duly justified (non-payment of rent, check without provision issued by the tenant, proven degradation of the rented premises, neighborhood complaints…). This cancellation, which occurs in person by registered mail, results in the departure of the tenant within two hours following the receipt of the letter notifying this decision. In this case, regardless of the cause of the termination, the entire amount of the rental remains acquired to SARL Domaine de Rochebonne. SARL Domaine de Rochebonne reserves the right to retain the amount of the deposit under the conditions specified in the "deposit" paragraph.

Article 15: INTERRUPTION OF STAY: In case of early interruption of the stay by the tenant, and if the responsibility of SARL Domaine de Rochebonne is not involved, no refund will be made, except for the security deposit.

Article 16: INSURANCES: SARL Domaine de Rochebonne is insured for professional liability with MMA ASSURANCES Number 146705093

Article 17: DISPUTES: Any complaint must be addressed as soon as possible to Domaine de Rochebonne 17320 St Just-Luzac, who will intervene to facilitate the amicable settlement of disputes:

  • if the contract was signed between SARL Domaine de Rochebonne and the tenant,
  • if the complaint is made within the first three days following arrival, for any dispute concerning the state of the premises or the description,
  • at the end of the stay for all other disputes.

For all disputes arising from the execution or interruption of this contract, only the Courts of the jurisdiction of the location of the property object of the rental are competent.
